Hi Guys,
My wife is going to go to school this August for her masters. I am on H1 she is here on H4 and My I 140 is cleared. Now my question is
1> Is it possible for her to convert to F1 (she is still not part of the GC process we haven't filed I 485)?
2> What is the process to get this conversion of status done?
3> How long does it take? (we live in California and she will be going to school in CA as well.)
4> I understand that for her to get OPT she should be on F1 but does it matter for how long she has to be on F1?
5> Just change of status is enough of would she need to get F1 Stamped?
Thanks a zillion for helping us out.

Hello Guys,
I need urgent help please.
I am on 8th year of my H-1B, expiring on July-2008.
I am on EB3 Nebraska, PD 07/2003.
I-140 pending RFE on Education (3 years degree) replied on December-2007
EAD approved on September-2007.
I485 aplied on july-2-2007
Just got an email from Cris that my I485 was denied. I dont know the reason.
My I140 is still pending almost 4 months after my attorney replied the I140 RFE.
Today I am writing this in order to understand my available options and strategy to this situation.
I have less than 2 months on H-1(b).
What are my options?
Anybody in the same situation?

Company A had applied for an RIR Labor app in Oct'2002. In Mar'06 we got a letter saying that case was closed. Then the attorney asked it to be reopened and it was reopened. Then now end of Aug we got the approval.
Im in my 8yr of extension based on this RIR.
Ok since then in early 2004 Company B bought Company A. Then in Mid 2004 Company C bought Company B. Attorney at that time said i dont need to file any H1 and can stay in the H1 from Company A because it was a successor of interest !
but now the attorney is saying that it will be very difficult to prove this is a successor in interest and there is no way we cna get the I140 approved.
So..
1. What do you guys think ? Has anyone gone thru' something like this. Any ideas ? I have also applied for PERM with the current company.
2. How long can I continue without filing I140 for the labor that was approved.

Friends,
I am starting this thread for the people who are Greencard Holders and not married. Please share some thoughts for bringing their spouse here.
IV can help in this matter.
If all visa holders and citizens can bring their spouse instantly then why GC holder have to wait for many years after getting GC after many years.
Thanks
Jet

With all of the publicity recently received in the cases of the abortion clinic and Holocaust museum slayings, I'm surprised that this crime has not been getting a lot of publicity: An outspoken anti-immigration activist who was at the center of a series of violent crimes in Everett earlier this year now stands accused of the home-invasion killings of an Arizona man and his 9-year-old daughter. Shawna Forde, 41, and two associates in her Minuteman American Defense group are charged with two counts of first-degree murder, one count of first-degree burglary and one count of aggravated assault, according to the...

Guys,
Have anybody feeling the big difference between Texas and Nebraska service center processing? Texas is giving greencards and June filers most of them have got EAD and Advanced Paroles. Is immigrationvoice doing anything to escalate the situation.
Nebraska June filers, post your updates here.
Just received FP notice for spouse's from NSC

off the Topic! Sorry. Wondering if any IVian has good idea about itemized deductions we can take while working on 1099-MISC instead of on W-2? There might be good chunk of Spouses working on 1099 in IT or other areas of expertise while working on EAD.what kind of expenses where we need to save receipts while filing Taxes later on in '09.
Thanks!
Thanks!

Reform Immigration For America reports that 500,000 people participated in May Day protests at 80 events around the country. I was attending my 20th law school reunion this weekend in Chicago so took the opportunity to attend the event in the Windy City. The crowd was enthusiastic with lots of signs criticizing SB1070 and calling for immigration reform. And lots of US flags .

My I-485 has been pending for more than 6 months now. I have an EAD but I got an RFE on my AP. I don't know what its about as I have not received the RFE yet.
I am thinking of changing my job. In my new job I don't want to use my EAD since my AP status is still hanging. Can I keep working on H1-B visa as I still have 3.5 years left on my H1? If I travel outside the country, can I re-enter with a valid H-1B visa? Can this cause an abandonment of AOS if I enter on H-1B while my AOS is pending? Please let me know. Thank you.

My attorney said she could get us to talk on one of the AILA meetings as she knows the AILA president very well. This could be awesome!! Let me know. I am from NY close to the City. She also asked if she could add link to immigrationvoice.org to her website.

Here's the news release from the ACLU: The American Civil Liberties Union and a coalition of civil rights groups filed a class action lawsuit today in the U.S. District Court for the District of Arizona challenging Arizona's new law requiring police to demand "papers" from people they stop who they suspect are not authorized to be in the U.S. The extreme law, the coalition charged, invites the racial profiling of people of color, violates the First Amendment and interferes with federal law. The coalition filing the lawsuit includes the ACLU, MALDEF, National Immigration Law Center (NILC), the National Association for...
